1. Introduction

Welcome to Plutus Mart ("Plutus Mart", "we", "us", or "our"). These Terms and Conditions ("Terms") govern your access to and use of the Plutus Mart website, platform, and services (collectively, the "Services"). By accessing or using the Services, you ("you" or "User") agree to be bound by these Terms. If you disagree with any part of the Terms, then you may not access the Services.

3. Store Creation and Management

3.1 Store Content: You are solely responsible for all content, data, and information that you upload, publish, or display in your Plutus Mart store ("Store Content"). You represent and warrant that you have all necessary rights and permissions to use and share your Store Content.

3.2 Prohibited Content: You agree not to use the Services to upload, publish, or display any Store Content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, libelous, invasive of another's privacy, hateful, or racially, ethnically, or otherwise objectionable.  

3.3 Intellectual Property: You retain all ownership rights in your Store Content. However, by using the Services, you grant Plutus Mart a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, adapt, publish, translate, distribute, and display your Store Content for the purpose of providing and promoting the Services.  

4. Payments and Fees

4.1 Pricing: Plutus Mart offers various pricing plans for its Services. The current pricing plans and their features are available on our website. We reserve the right to modify our pricing plans at any time.

4.2 Payment Processing: Plutus Mart integrates with third-party payment processors to facilitate transactions between you and your customers. You are responsible for complying with the terms and conditions of these payment processors.

4.3 Refunds: All refund requests are subject to our refund policy, which is available on our website.

5. Prohibited Activities

You agree not to:

  • Use the Services for any illegal or unauthorized purpose.
  • Violate any applicable laws or regulations.
  • Infringe upon the intellectual property rights of others.
  • Interfere with or disrupt the Services or servers or networks connected to the Services.  
  • Attempt to gain unauthorized access to the Services or other users' accounts.  
  • Use the Services to transmit any viruses, worms, defects, Trojan horses, or other items of a destructive nature.
  • Use the Services to collect or harvest any personally identifiable information, including account names, from other users.
  • Engage in any activity that could damage, disable, overburden, or impair the Services.

6. Termination

6.1 Termination by You: You may terminate your account at any time by contacting our customer support.

6.2 Termination by Us: We may terminate your account or suspend your access to the Services at any time for any reason, including but not limited to your breach of these Terms, violation of any applicable laws or regulations, or if we believe that your use of the Services poses a risk to us, other users, or the integrity of the platform.

7. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.  

8. Limitation of Liability

IN NO EVENT SHALL PLUTUS MART BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.  

9. Indemnification

You agree to indemnify and hold Plutus Mart and its affiliates, officers, directors, employees, and agents harmless from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your use of the Services or your breach of these Terms.  

10. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the United Arab Emirates. Any dispute arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the courts of the United Arab Emirates.  

11. Entire Agreement

These Terms constitute the entire agreement between you and Plutus Mart relating to your use of the Services and supersede all prior or contemporaneous communications and proposals, whether oral or written.  

12. Changes to Terms

We may update these Terms from time to time. We will post the updated Terms on our website and notify you of any material changes. Your continued use of the Services following the posting of the updated Terms constitutes your acceptance of the changes.
